联合声明:恳请ICE暂缓递解段春霞女士书

我们是从事中国人权活动及关心中国人权状况的人士,为段春霞女士即将被遣返中国吁请ICE暂缓执行。

段女士是中国江苏省著名人权人士倪金芳的妻子。因长期从事人权活动,倪先生一直经受中共迫害,曾被拘禁失去自由171天,释放后仍旧遭中共不断骚扰、迫害。长期以来,段女士竭力支持倪先生的抗议斗争,因此不断受到中共迫害。



2022年,倪金芳携女儿逃往美国,因此惹怒了中共,于是更加严厉地打击报复段女士。鉴于家庭分裂和自己经受的严重迫害,段女士于2024928日通过走线来到美国,现在乔治亚州移民监狱。因为她有严重的视力疾患,生活极为困苦。鉴于中共一向残酷迫害逃离国境的公民,尤其是人权人士,如果把段女士遣返中国,她一定会遭到中共的无情迫害,且再也难以与身在美国的丈夫和女儿团聚,这无疑是一场严重的人道悲剧。

美国自立国开始是一个移民国家,全世界被迫害的人纷纷来到美国,以逃避其在母国经受的政治迫害,他/她們在此寻求庇护,努力建立新的生活,为使美国继续成为一個充满希望与自由的国土,做出贡献。同时,根据美国在199410月批准的联合国《禁止酷刑及其他残忍不人道或有辱人格之待遇或处罚公约》:“1. 如有充分理由相信任何人在另一国家将有遭受酷刑的危险,任何缔约国不得将该人驱逐、遣返或引渡至该国。2. 为了确定这种理由是否存在,有关当局应考虑到所有有关的因 素,包括在适当情况下,考虑到在有关国家境内是否存在一贯严重、公然、大规模侵犯人权的情况。“(第三条)。

中华人民共和国是当今世界上最大的迫害人权、制造人道灾难的国家,其对治下的人民、包括藏族维吾尔族汉族等所有个民族实施暴力统治和残酷压迫,如果将段女士递解回国,正是中共求之不得的,其遭遇至少将会像在2023年被老挝当局送囘中国的人权律师卢思位先生一样,受到任意拘禁、不公平的起诉和审讯,甚至入狱。这样的前车之鉴昭然存在,而且也是对中国民主人士的沉重打击。

因此,我们恳请美国ICE延缓递解段春霞女士回归中国(附件:个人简历)。

Plea to ICE to Suspend the Deportation of Ms. Duan Chunxia We are a group of
human rights defenders and activists who are concerned about the human rights
situation in China. We hereby appeal to the ICE to suspend the deportation of
Ms. Duan Chunxia (
段春霞) to China. Ms. Duan Chunxia is the wife of Ni Jinfang (倪金芳), a prominent rights defender in Jiangsu Province, China. Ni
Jinfang has long been persecuted by the Communist Party of China (CPC) for his
human rights activities. He was arbitrarily detained for 171 days while in
China and continued to be harassed and persecuted after his release. Ms. Duan
had always been supporting Ni
s work and was hence also
made subject of persecution by the Chinese authorities.

In
2022, Ni fled to the United States with their daughter. The CPC was angered and
exerted even harsher retaliation against Ms. Duan.In light of the family split
and the severe persecution she endured, Ms. Duan came to the United States
through a walk-in route on 28 September 2024. She is now in an immigration
prison in Georgia. Because of her serious visual impairment, her life has been
very difficult. The CPC has a notorious record of brutally retaliating against
citizens, especially the rights defenders, who seek to flee the country, we are
gravely concerned of the plight of Ms. Duan if she is returned to China where
she would highly likely be persecuted by the authorities and forbidden to
reunite with her husband and daughter now seeking asylum in the United States.
This will undoubtedly be a serious humanitarian tragedy.

Since
its founding, the United States has been a nation of immigrants where
persecuted people from around the world seek refuge, rebuild their lives and
unceasingly contribute to make this a land of hope and freedom. United States
ratified the United Nations Convention against Torture and Other Cruel, Inhuman
or Degrading Treatment or Punishment in October 1994. Article 3 of the
Convention stipulates that 1. No State Party shall expel, return (
refouler) or extradite a person to another State where there are substantial
grounds for believing that he would be in danger of being subjected to torture.
2. For the purpose of determining whether there are such grounds, the competent
authorities shall take into account all relevant considerations including, where
applicable, the existence in the State concerned of a consistent pattern of
gross, flagrant or mass violations of human rights.

The
People
s
Republic of China is the world
s largest perpetrator of
human rights violations, with notorious records suppressing peoples under its
regime, including the Han Chinese, Tibetans and Uyghurs. The CPC would be
pleased to see rights defenders like Ms. Duan deported back to China, where she
would face the same fate as Mr. Lu Siwei, a human rights lawyer arrested in
Laos and returned to China in 2023 to be arbitrarily detained, unfairly
prosecuted and convicted for imprisonment. This precedent not only represents a
setback for those advocating for democracy in China but also calls for our
serious caution.

In
this light, we urge the U.S. ICE to suspend the deportation of Ms. Duan Chunxia

我是来自中国的人权活动人士倪金芳,2022我和女儿持旅游签证入境来到美国,目前正在寻求政 治庇护,日前,我的妻子段春霞收到美国移民局的遣返令,129日也就是6天后即将被遣返中
国,根据旅行证文件,她将直接被送回中国沈阳。

 

我的妻子先前在中国多次遭到警察的迫害,包括威胁,恐吓,任意关押,强迫我妻子录视频发给
我让我禁声。如果我的妻子被遣返,她将再次面临被迫害,甚至可能会被抓捕而入狱以及被中国 政府限制出境,而我和女儿因为不能回国恐怕此生再也见不到她。 这里我恳请您写信给美国ICE,暂缓遣返,以换取时间供我们的律师申诉。

以下是我的个人简历:

我是苏州的公民,2012123日,范木根反抗中共暴力强拆手刃歹徒,中国人权律师和苏州公
民们相继介入救援范木根,我参与其中,这个事件成为2015709大抓捕的导火索。

2015年,中国政府在79日实施了大抓捕,先后有300多位中国人权律师被抓,震惊中外,这个 事件被称为709 Crackdown,链接如下:
